8. The Federal Trade Commission Endorsement Guides

The new Federal Trade Commission (FTC) rules for influencers precisely mention that influencers have to clearly reveal brand endorsements to their followers in their posts. While plenty of advertisers and influencers seem to be getting on board with more clear disclosures of their partnerships; many may still be lagging with those that fall in a gray area. The FTC's Endorsement Guides provide that if there is a "material connection" between an endorser and an advertiser - in other words, a connection that might affect the weight or credibility that consumers give the endorsement - that connection should be clearly and conspicuously disclosed, unless it is already clear from the context of the communication. A material connection could be a business relationship, monetary payment, or the gift of a free product. Brands, as well as influencers and ambassadors, need to invest some time into understanding the FTC guidelines and requirements for branded content. For the latest information you can review the updated version of The FTC's Endorsement Guides: What People are Asking, a staff guidance document that answers frequently asked questions.
